Welcome to the usafacts.org website (this “Site”). This Site is owned and operated by USAFacts Institute, a Delaware nonprofit, nonstock corporation (“USAFacts”). The terms and conditions under which you may use this Site are set forth below and on the Privacy Policy page. All such terms and conditions are collectively referred to as the “Terms & Conditions.” By using this Site, you agree to be bound by the agreement set forth in the Terms & Conditions. If you do not agree to be bound by the agreement set forth in the Terms & Conditions, you must not use this Site.

This Site is available to users who are 13 years of age or older. If you are not 13 years of age or older, USAFacts requests that you not use this Site.

FACTS, FIGURES AND U.S. GOVERNMENT REPORTS

The facts, figures, and United States government reports cited or quoted on this Site are not subject to copyright or other intellectual property right protections in the United States. The purpose of this website is to make such information available to all people, and USAFacts encourages you to use this information for education, analysis and discussion regarding government activities.

ORIGINAL CONTENT

If you are a California resident, you expressly waive your rights under California Civil Code section 1542 which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”

NO WAIVER

SEVERABILITY

If a court of competent jurisdiction determines that any clause or provision of the Terms & Conditions is illegal, invalid or unenforceable under present or future law, such clause or provision shall be deemed to be deleted and severed from the Terms & Conditions without affecting the enforceability of all remaining clauses or provisions.

ENTIRE AGREEMENT

The Terms & Conditions constitute the sole and entire agreement between you and USAFacts regarding this Site and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, regarding this Site.

GOVERNING LAW AND JURISDICTION

The Terms & Conditions and any dispute arising under or related to the Terms & Conditions or to this Site shall be governed by the laws of the state of Washington, without reference to its conflict of law principles. Any such dispute shall be resolved exclusively in the state or federal courts in King County, Washington. You agree to submit to the personal jurisdiction and venue of courts located in King County, Washington for any legal proceeding involving this Site, regardless of who initiated such legal proceeding.
